In the event the individual mandate is upheld because healthcare is a "unique" market that has an "inordinate" impact on the nation's economy, please be advised that I shall forthwith beginning lobbying Congress and every other elected official (and unelected apparatchiks) to pass laws requiring all individuals and businesses to insure against financial "illness" and its "catastrophic effects, including personal bankruptcy and effects on the nation's economy." Thus, all persons owing money to any financial institution that is insured by the Federal government, including insurance companies pursuant to former Senator Chris Dodd's amendment to the FDICIA of 1991, will be forced to insure against default.

Want to buy a home and need a mortgage? You will henceforth be mandated by the Federal government to carry mortgage insurance until your mortgage is paid off regardless of your credit history, credit rating, net worth, and employment history.

Want to finance an automobile? You will henceforth be mandated by the Federal government to carry loan insurance until your loan is paid off regardless of your credit history, credit rating, net worth, and employment history.

Want to have a credit card? You will henceforth be mandated by the Federal government to carry default insurance for as long as your account is open regardless of your credit history, credit rating, net worth, and employment history.

After all, we have seen the catastrophic effects of foreclosures and other credit defaults on the economy.

Oh, and there will be no exceptions under the Community Reinvestment Act.

Of course, if that happens, be prepared for a full-court meltdown among the Left, where the argument has already arisen that the Roberts Court is the Most Activististist Court Evah, with Jeffrey Toobin and (Politico’s) Roger Simon leading the way.  Gabriel Malor demolished this argument on Twitter yesterday, and he compiled his rebuttal into a blog post this morning:

Here’s the data on the first five years of the Roberts Court (gleaned from this NYTimes infographic):
(1) The Warren, Burger, and Rehnquist Courts overturned precedent decisions at an average rate of 2.7, 2.8 and 2.4 per term, respectively. By contrast, the Roberts Court overturned precedent only at an average rate of 1.6 per term.(2) The Warren, Burger, and Rehnquist Courts overturned laws at an average rate of 7.9, 12.5, and 6.2 laws per term. By contrast, the Roberts Court struck down laws only 3 laws per term.
Just three laws per term! Far, far from being “eager” to overturn legislatures, as hack Toobin dribbled, and obviously, indisputably playing no unusual role in “second-guessing laws,” as Fallows alarmingly squeaked, the Roberts Court has been a model of restraint. Restraint is, naturally, one of Chief Justice Roberts’ well-known characteristics and it was remarked upon during his confirmation hearings. One could even creditably call the Roberts Court the most restrained, incrementalist Court of the modern era. (I assure you, these numbers have not changed appreciably in the past two years.)

As I have demanded of Progs and Obamacare supporters for 3 years, cite one…just one…example where the Federal government, under the auspices of the Commerce Clause, as EVER mandated individuals enter into third-party contracts with private entities for the provision/procurement of government-provided goods or services as a condition of good citizenship.

THERE IS NO PRECEDENT…which even the judges that upheld Obamacare recognised when they wrote that it was a “case of first impression.”

You cannot overturn a precedent where none exists.
